The term “without will” means just that—the deceased had not prepared a will to define how his property and assets would be distributed at the time of his death.

When there is not a will, the deceased’s property must go through the probate process. The court assigns a representative to deal with all claims against the estate, pay the taxes and debts of the estate, and distribute all remaining assets and property.
