A will becomes a will in probate when a court issues an order of probate. At that point, a probate attorney is assigned who then reviews the complete context of the will and determines the distribution of cash and real assets.

A will remains in probate until all debts are paid, property has been disbursed, and taxes and debts owed by the estate are paid.
