The terms “will” and “last will and testament” are often used synonymously. The
term “testament” is used at times to describe the part of the will that is in the
deceased’s own words or when describing the personal property of deceased.
When a will is prepared, the signer of the will “testifies” as to
the distribution of his property and assets at the time of his death and to the
exact purpose and intent of the will. The will and testament must be legally signed
and witnessed to be valid.
