If you are to receive a gift under a Will or an Estate and the Will or Estate is disputed, you must take immediate steps to ensure that your inheritance is not taken away from you. Delay can lead to disaster.

The Personal Representative or Executor of the Will has an obligation to defend the terms of the Will. You should get independent advice if the Personal Representative:

Has not taken steps to protect your inheritance;
Has not made your rights in the dispute clear;
Does not keep you informed with how the dispute is progressing;
Does not have the same view as you in relation to the defence of your inheritance; or
Is the Public Trustee or a professional Trustee or Executor Company.

It is common for the Public Trustee or a Professional Trustee or Executor Company to be appointed as Executor under a Will. Professional trustees are effective at administering Deceased Estates but in our experience, if an Estate becomes the subject of a dispute they prefer for the interested beneficiaries to defend their own gift.
