A casual term that is used to describe a will that is in probate. A probate court (sometimes called a “surrogate” court) first determines the validity of the will then and adjudicates the interests of heirs and other parties who have claims against the estate.

The term probate will is used during the time that the court interprets the instructions of the will and determines and resolves taxes and debts of an estate.
