Whenever an owner of an estate dies without a will that is clear and valid, the property and assets of the deceased can be placed in probate.

Typically, a probate court will assign a probate attorney to review the will, the estate, all potential heirs and beneficiaries.

The first step is usually determining the validity of the will and whether or not it is a legal and binding document. The probate of a will can take considerable time and effort and often takes weeks or months before all issues of the will are rectified.
