Sometimes called a “surrogate” court, a probate court considers only cases concerning the distribution of a deceased’s person’s estate. The court examines the authenticity of a will and deal’s with the debts and taxes of the deceased.

Probate court is often involved in payment of the debts of the deceased as well as the proper distribution of their assets to their legal inheritors who are normally family members.
