An attorney who specializes mostly or entirely on issues of probate. Their duties are to some degree determined by the court. For example, the probate attorney determines who is entitled to receive real cash or property from the estate of the deceased.

Deciding the validity of a will is also overseen by a probate attorney. They often attend to any challenges to the will (contests of will) by family members or third parties. Another duty of the probate attorneys is making sure the probate laws of a particular state are being followed.

Essentially, the probate attorneys acts as a representative of the probate court.
