In order for the probate process to begin, it must be granted by the court.

The first step of probate is the process of determining whether a will is valid. If the court determines the will is valid, the court then "admits" the will to probate where any attorney is in charge of the inheritance and disbursement as set down in the will.

Probate is also used when there is a question of the legitimacy of beneficiaries or heirs or if there are problems with the structure of the will.
